Terms of Service

1. Who we are

PowerPark (“PowerPark,” “we,” “us,” or “our”) provides tools for EV drivers and charging operators, including charger discovery, session start/stop, payments and wallet features, and operator console capabilities.

2. Eligibility and accounts

• You must be at least 16 years old (or the age of digital consent in your country) to use the Services.
• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your login credentials and for activity under your account.
• Notify us promptly at hello@powerpark.io if you suspect unauthorized access.

3. The Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.

PowerPark may:

• Connect you with charge points operated by PowerPark or third-party operators
• Display availability, pricing, and session status that depends on network and operator data
• Process payments, wallet top-ups, and session charges through payment partners
• Provide operator tools for managing sites, charge points, users, tariffs, and reports

Charger availability, power levels, pricing, and session success are not guaranteed and may depend on equipment, site conditions, grid limits, and third-party operators.

4. Charging sessions and conduct

When using charging features, you agree to:

• Use chargers and sites safely and in accordance with posted rules and applicable law
• Only start sessions you are authorized to start (including RFID, QR, or in-app flows)
• Not interfere with equipment, other users, or network operations
• Not attempt to reverse engineer, scrape, overload, or disrupt the Services
• Not use the Services for unlawful, fraudulent, or abusive purposes

You are responsible for your vehicle, cable connections, and following on-site safety instructions. PowerPark is not responsible for damage arising from improper use of charging equipment or site facilities.

5. Payments, wallet, and pricing

• Session prices may include energy fees, time-based fees, idle fees, taxes, or other charges set by PowerPark or the site operator.
• Displayed estimates may differ from final amounts based on actual energy delivered and tariff rules.
• Wallet balances and payment methods are used to pay for eligible sessions and top-ups.
• Payment processing may be handled by third-party providers; their terms may also apply.
• Fees are generally non-refundable except where required by law or expressly stated by us.

We may suspend charging or account access if a payment fails, fraud is suspected, or your wallet balance is insufficient.

6. Operator and business use

If you access operator console or business features, you are responsible for configuring charge points, tariffs, users, and access correctly; ensuring you have rights to operate the sites and equipment you manage; and complying with applicable energy, safety, and consumer laws. Operational data shown in the console depends on charger connectivity (including OCPP) and may be delayed or incomplete when devices are offline.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of how we operate the Services.

8. Intellectual property

The Services, including software, branding, logos, text, graphics, and related content, are owned by PowerPark or its licensors and are protected by intellectual property laws. Except for the limited rights granted in these Terms, no license is granted. You may not copy, modify, distribute, sell, or create derivative works from the Services without our prior written consent.

9. Third-party services

The Services may integrate with third parties such as maps, identity providers, payment processors, and charging hardware or networks. We are not responsible for third-party services, and their terms and privacy policies apply to your use of them.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERPARK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR CHARGER WILL BE AVAILABLE OR DELIVER A SPECIFIC POWER LEVEL OR ENERGY AMOUNT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERPARK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO POWERPARK FOR THE SERVICES IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnity

You agree to defend, indemnify, and hold harmless PowerPark and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or if we discontinue the Services. Upon termination, rights granted to you under these Terms end. Sections that by nature should survive (including payments owed, disclaimers, limitations, and indemnity) will survive.

14. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Services.

15. Governing law

These Terms are governed by the laws applicable in the jurisdiction where PowerPark principally operates, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise.
